Terms of Use
1. Overview
Welcome. These Terms of Use govern your access to and use of TripMatters’ services and the tripmatters.net website (“Site”). By using our services, arranging travel through us, or accessing the Site, you agree to be bound by these terms. If you do not agree, please discontinue use.

2. Acceptance of Terms
These terms set out your rights and obligations, include disclaimers and liability limits, and grant us protections. They constitute a fair balance given the convenience of our Site and services. Continued use after changes are posted constitutes acceptance of those changes.

3. About Us
TripMatters (“Agency,” “we,” “us,” or “our”) is located at 13891 Newport Avenue, Suite 250, Tustin, CA 92780, which you may use to reach us as an alternative to the Site.

4. Traveler Responsibilities
  • Identification: You and your travel companions must carry valid passports, visas, and any other required documents. TSA guidance on acceptable IDs is at www.tsa.gov/traveler-information/acceptable-ids.
  • Expiry: Many countries refuse entry if a passport expires within six months of travel. Non-U.S. citizens may need additional paperwork. 
  • Children: Children and infants need the same documents; single-parent or unaccompanied minors may require authenticated parental consent.
  • Criminal History: Countries have varying rules on past offenses. You must verify entry/exit requirements directly with authorities. Visa issuance does not guarantee entry; delays or denials are not refundable.

5. Safety & Warnings
No destination is risk-free. You are responsible for staying informed—consult U.S. State Department (www.state.gov), CDC (www.cdc.gov), TSA, DOT, FAA, and CBP sites. Consider enrolling in STEP (https://step.state.gov/step/) to receive updates and for emergency contact. You assume all safety risks associated with travel.

6. Booking & Payment
  • Legitimate Reservations: Only make bona fide travel bookings. Fraudulent or speculative reservations are prohibited.
  • Third-Party Suppliers: We act as booking agent; each supplier’s terms (airlines, hotels, tour operators) apply. You must comply with those terms. 
  • Payment: Final payment deadlines are set by each supplier. Late or missing payment may lead to cancellation and forfeiture of deposits.
  • Cancellation: Requests must be in writing. Supplier and Agency cancellation fees apply as published in your travel documents or on the Site.
  • Travel Insurance: Optional insurance is available to protect against supplier default, cancellation, medical emergencies, lost baggage, and more. Insurance is not included by default.

7. Changes & No-Show
  • Modifications: We cannot guarantee changes to confirmed bookings; fees may apply.
  • Unused Services: No refunds for unused portions of a booking. Group tours with minimum-passenger requirements may incur surcharges or cancellation if not met.
  • Currency & Taxes: Prices may change due to exchange-rate fluctuations or government-imposed fees. Departure taxes often must be paid in cash at the port or airport.

8. Health & Special Needs
  • Health Documentation: You must obtain required immunizations and carry valid-certificates. We are not responsible for health requirement accuracy.
  • Pregnancy: Airlines and cruise lines have their own pregnancy policies. You must verify and comply with those policies.
  • Disabilities: Advise us at booking of any special needs. Many providers lack full ADA compliance—companions may be required.

9. Hazardous Materials & Insecticide
  • Hazardous Goods: U.S. law prohibits carrying materials like explosives, flammables, and certain chemicals. Check TSA and FAA guidelines before travel.
  • Insecticide: International regulations may require in-cabin spraying; see DOT’s aircraft disinsection rules at www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.
 
10. E-Tickets & Expiration
E-tickets typically expire one year from issue unless otherwise specified. No refunds are issued for expired tickets.

11. Limitation of Liability
Because we act as agent, we are not liable for supplier acts or omissions. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE COMMISSIONS AND FEES YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM. WE DISCLAIM ALL INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

 
12. Force Majeure
We are not liable for delays or non-performance caused by events beyond our control (acts of God, war, strikes, government actions, disease, weather, etc.). We may adjust or cancel itineraries at our discretion without obligation to refund.

13. Intellectual Property
All Site content is owned or licensed by us and protected by law. You may view and print content for personal, non-commercial use only. Any other use requires our prior written consent.

14. Website Use & Acceptable Conduct​
  • Access: We may modify or suspend access at any time.
  • Lawful Use: You must not misuse the Site or introduce harmful code (viruses, malware).
  • Links: You may link to our home page only in compliance with our link policy; contact info@tripmatters.net for permission to use other material.
 
15. Privacy & Data
Our Privacy Policy at https://www.tripmatters.net/privacy-policy governs data handling. By using the Site, you consent to its terms.

17. Governing Law & Dispute Resolution
These terms are governed by California law. Any claim must be filed within one year of accrual in California courts. You may not bring a class-action suit.
